The law firms Cintioli e Associati (Prof. Fabio Cintioli and Attorney Paolo Giugliano) and Tremonti Piccardi Romagnoli e Associati (Prof. Giulio Tremonti and Attorney Giuseppe Pizzonia), acting on behalf of a leading electricity operator, obtained, before the Lazio Regional Administrative Court, referral to the Constitutional Court of the legitimacy judgment regarding the temporary solidarity contribution for 2023 introduced by Article 1, paragraphs 115 et seq. of Law No. 197 of 29 December 2022. In the relevant Order, in confirming its jurisdiction in the matter, the Regional Administrative Court found the appellant's arguments on the merits to be well-founded, highlighting conflicts with European Union legislation and the Constitution.
